Immigration and Customs Enforcement (ICE) issues an NTA against someone has already entered the United States and is unlawfully present. And United States Citizenship and Immigration Services (USCIS) issues an NTA against someone who voluntarily applies for a benefit for which he or she is found to be ineligible.

Most people who receive an NTA have simply overstayed their visas. Some were perhaps already planning a voluntary departure.
